PURPOSE OF NOTICE

When you use the "Blubear" application, you entrust us with your data. By registering to use the "Blubear" application and accepting the Terms of Use and Privacy Policy (hereinafter: Rules), you consent to Blubear d.o.o processing your personal data that we collect, in the manner we use and share them, as outlined in these Rules, for the duration of your registration as a "Blubear" application user.

Personal data is any information relating to an identified or identifiable natural person, such as name, age, photograph, or location. Anonymized data is not considered personal data. Processing includes any operation or set of operations performed on personal data or sets of personal data (e.g., collection, storage, use, reproduction, disclosure, deletion, or destruction).

DATA YOU PROVIDE

These may include but are not limited to:

User profile: We collect data when creating or updating your account. This may include your name, email address, phone number, username, login password, information about your vehicle (for service providers), and Blubear Application may also collect your photograph (for using a profile picture in the application).

Demographic data: We may collect demographic data about you, including user surveys.

User content: We may collect data you submit when contacting "Blubear" customer support, providing ratings or commendations for other users, or other ways of contacting the "Blubear" application.

DATA GENERATED DURING YOUR USE OF OUR SERVICES

These may include but are not limited to:

Location data

Depending on your application settings or device permissions, we may collect precise or approximate location data determined based on data sources such as GPS.

If you are a user and have granted permission for the processing of location data, "Blubear" collects location data when it is operating in the foreground. If you are a service provider, in that case, data is collected even when the app is in the background.

Users can use the "Blubear" application without enabling "Blubear d.o.o" to collect location data. However, this may have a negative impact on the available features in the "Blubear" application. Additionally, location data is collected from taxi drivers during your ride and associated with your account, even if you have not enabled "Blubear d.o.o" to collect your location data.

Transaction data:

We collect details of transactions related to your use of our services. This includes order details, date and time of service provision, and distance traveled.

Usage data on the presentation website:

We collect data on how you interact with our services. This includes data such as dates and times of access, viewed features, browser type, etc. In some cases, we collect this data through cookies, pixel tags, and similar technologies that create and maintain unique identifiers.

User feedback such as ratings and commendations.

DATA USAGE

"Blubear d.o.o." uses the data it collects to provide, personalize, maintain, and improve services. This includes but is not limited to the use of data for:

Creating and updating your account.

Confirming your identity.

Tracking the progress of your ride.

Enabling features that allow you to share data with others, such as praising a taxi driver, recommending a friend to "Blubear," sharing ride prices, or sharing your estimated time of arrival.

Enabling features to personalize your account, such as creating tags for your favorite places and enabling quick access to previous destinations.

Performing internal operations necessary to provide our services, including software troubleshooting and operational issues, data analysis, testing, and research, as well as monitoring and analyzing usage and activity trends.

Research and development:

The data we collect may be used for product testing, research, analysis, and development. This allows us to improve the safety of our services and develop new features to enhance the user experience new features and products and facilitate finding insurance and financial solutions related to our services.

Communication between Users and Third Parties:

"Blubear d.o.o." uses the data it collects to enable communication between Users and Third Parties. For example, a taxi driver may send a message or call the user to confirm the pickup location.

Communication with "Blubear d.o.o.":

"Blubear d.o.o." may use the data it collects to communicate with the User via email, mobile notifications, and SMS messages.

Legal Proceedings and Requests:

We may use the data we collect to investigate or resolve claims or disputes related to your use of services or as otherwise permitted by applicable law or regulatory requirements, government agencies, and official inquiries.

DATA SHARING

At your request

With the general public when you submit content to a public forum

User feedback is very important to us, including those posted on public forums such as social media and certain features on our network. When you communicate with us through these channels, your messages may become publicly visible.

For legal reasons or in case of dispute

"Blubear d.o.o." may share your data if it believes it is required by applicable laws, regulations, operational agreements, legal proceedings, or if requested by authorities, or in cases where disclosing data is appropriate for security or similar reasons.

This includes sharing your data with law enforcement officials, government administration, or other third parties to enforce our terms of service, user agreements, or other rules, protect the rights or property of "Blubear d.o.o." or others, or in the event of claims or disputes regarding your use of services. If you use someone else's credit card, we may be legally obligated to share your data with the credit card owner, including ride data.

This also includes sharing your data with others in the event of or during negotiations for any merger, asset sale of the Company, consolidation or restructuring, financing, or acquisition of the Company by another company or upon entering into another company.

With your permission

Blubear d.o.o. may share your data in ways not specified in these rules if it notifies you and you give permission for such sharing.

USER RIGHTS

As users of the "Blubear" application, you have the following rights regarding the handling of your personal data:

Information: the right to be informed about how we process your personal data (this right is fulfilled by providing you with this Privacy Policy);

Access: the right to request access to all your personal data that we process. If you request electronically, the information is provided in a commonly used electronic format unless you request otherwise;

Correction/Supplementation: the right to request that incorrect or incomplete personal data about you be corrected without delay. Please inform us if you change your personal data or if you become aware that any personal data we hold is incorrect or incomplete;

Deletion: the right to request the deletion of your personal data without delay (subject to limitations imposed by law);

Restriction: the right to request restriction of processing of your personal data in certain situations;

Objection: the right to object to specific processing of personal data. This includes direct marketing, processing for scientific or historical research purposes, or statistical purposes.

Generally, we process your personal data if such processing is necessary for us to conclude and perform a contract with you (Terms of Use). We may process your personal data if required by law. Also, we may process your personal data if processing is necessary to protect your vital interests. Additionally, we may process your personal data to pursue our legitimate business interests. We only use personal data that is necessary for a specific purpose and always strive to limit the processing of personal data to what is necessary for that purpose.

By accepting the Terms of Use, you enter into a contract with us. We process your personal data to conclude and perform that contract. All data is collected and processed in accordance with applicable laws and GDPR.

You can revoke your consent at any time. If you revoke your consent, you will not be able to use any service or feature that requires the collection or use of data we have collected or used based on consent.

"Blubear d.o.o" requires consent for the collection or use of data necessary to enhance user experience, enable additional services or features, or communicate with users.

"Blubear d.o.o" may collect data about you through voluntary surveys. Your responses to such surveys are collected based on consent and will be deleted when they are no longer needed for the purpose for which they were collected.

PRIVACY SETTINGS

The Privacy Settings menu in the "Blubear" application for users allows you to set or update location and contact sharing settings, as well as your preferences for receiving notifications from the "Blubear" application. Information about these settings, how to set or change them, and their effects when disabled are described below.

Location Data:

"Blubear" utilizes the location services of the user's device to provide a safe and reliable ride at all times. Location data contributes to improving our services, including pickup, navigation, and customer support.

You can enable/disable or adjust the collection of user location data at any time through the settings of your mobile device. Disabling location services on your device will affect the use of the "Blubear" application. For example, you will need to manually enter pickup locations. Additionally, location data is collected from drivers during rides and associated with your account, even if you haven't enabled location tracking in the "Blubear" application.

Real-Time Location Sharing (Users):

If you have enabled location services on your mobile device, you can also allow the "Blubear" application to share your location with the taxi driver from the moment you send a request until the start of the ride. This facilitates pickup for the taxi driver.

You can enable/disable sharing your location with the taxi driver at any time through the Privacy Settings menu in the "Blubear" application. You can still use the "Blubear" application without enabling location sharing, but the taxi driver may have difficulty locating you.

Notifications: Account and Ride Updates:

The "Blubear" application provides users with notifications about the status of their ride. These notifications are an important part of using the "Blubear" application and cannot be disabled.

The "Blubear" application uses push notifications to ensure smooth operation and provide you with relevant information about the availability of "Blubear" services. Notifications inform you about the availability of service providers, estimated time of arrival, service provider location, etc. Without activated notifications, the "Blubear" application would not function properly, and you would not be able to view available service providers or estimate arrival times, etc. Notifications are also used to send system notifications related to the "Blubear" application (such as regular application updates or notifications about any disruptions).

The "Blubear" application uses notifications to inform users about the latest promotions, news, etc. If you do not wish to receive promotional messages via notifications, you can withdraw your consent to receive promotional messages via notifications at any time by disabling the option to receive notifications for our application in your phone settings. Although this is not an optimal solution, operating systems (Android, iOS) currently do not allow separating the purposes of notifications. Please note that if you disable the option to receive notifications (to avoid receiving promotional messages) due to system limitations, you will not be able to use our application to its full extent. If you have difficulty disabling promotional notifications on your mobile device, feel free to contact us via email: support@blubear.app. We will promptly respond and stop sending promotional messages.

DEVICE PERMISSIONS

Most mobile platforms (iOS, Android, etc.) have defined certain types of device data that applications cannot access without your consent. These platforms have different permission systems for obtaining your consent. The iOS platform will alert you when the "Blubear" application first requests permission to access certain types of data and will allow you to grant (or deny) consent for that request. Devices with the Android system will notify you of the permissions that the "Blubear" application requests before its initial use, and the use of the application itself implies consent.

OPTING OUT OF RECEIVING MARKETING MESSAGES

You can opt out of receiving promotional email messages from the "Blubear" application by clicking on the unsubscribe link in the email you received. You can also opt out of receiving email and other messages from the "Blubear" application by following the instructions provided in those messages. Please note that despite disabling marketing messages, we may still send you non-promotional messages, such as ride receipts or account information.

UPDATING POLICIES

These policies may be updated periodically. In the event of significant changes, we will notify you through the "Blubear" application or by other means, such as email. To the extent permitted by applicable law, by using the Services after receiving such notice, you will confirm that you agree to the updated policies. We encourage you to periodically review the policies to familiarize yourself with the latest information about our privacy practices. Previous versions of our privacy policies will also be available for review. We use your personal data solely to fulfill your orders, for administrative purposes, and to improve our services. If you wish to remove your data or restrict the way we process it, feel free to contact us at support@blubear.app. It is also important to note that our presentation website uses "cookies" that enhance your browsing and usage experience. You agree to their use when visiting our site, but you have the option to block them, although this may affect the functionality of some parts of the site.
